Terms of Service

By accessing or using lullabygen (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

lullabygen is a personalized lullaby service that allows users to create lullabies tailored to their baby's sleep needs. The Service includes personalized lullaby creation and email delivery, and we continuously work to improve it.

The Service is intended for users who are 18 years of age or older. If you submit information related to a child (such as age, name, or sleep preferences), you confirm that you are a parent, guardian, or have legal authority to provide such information on their behalf.

You do not need to create an account to use the Service. The email address you provide at checkout serves as your order identity. You are responsible for providing a valid email address that you control. Access to order status and completed lullabies may require email verification.

Each lullaby is personalized based on the selections you provide at checkout, including your baby's age, sleep situation, sound style, and emotional preferences. Results may vary based on your selections and preferences. We do our best to create a lullaby that reflects your choices, but creative results are subjective and every personalized result is unique.

The Service operates on a one-time payment model. Current pricing is displayed at checkout. Each purchase includes one personalized lullaby delivered by email.

Payments are processed by Creem, our merchant of record. Standard delivery is typically 3–7 days. Optional 24-Hour Priority Delivery (+$20) prioritizes your order for delivery within 24 hours.

The 24-Hour Priority Delivery fee is generally non-refundable once priority processing has begun, except where required by law or where we fail to meet the promised priority delivery timeframe.

Finished lullabies are delivered by email and may also be accessible through secure order tracking after email verification. You are responsible for providing a valid email address. Delivery is considered complete when the lullaby has been made available to the email address you provided and/or through secure order access.

We recommend downloading your lullaby promptly after delivery. Secure order access is generally available for at least 30 days after delivery. For recent orders, contact hello@lullabygen.com if you need to regain access.

We offer a 30-Day Satisfaction Guarantee. If you're not satisfied, contact us within 30 days of delivery and we will work with you to make it right — including a remake or refund depending on the issue and your preference.

The 24-Hour Priority Delivery fee is generally non-refundable once priority processing has begun, except where required by law or where we fail to meet the promised priority delivery timeframe. For full details, please refer to our Refund Policy.

Lullabies generated through the Service are licensed to you for personal, non-commercial use. You may share generated lullabies with family members.

You may not resell, redistribute, or commercially exploit generated lullabies.

You agree not to: use the Service for any unlawful purpose; submit false, misleading, or unauthorized information; attempt to interfere with, misuse, scrape, or reverse-engineer the Service; access or attempt to access orders that are not yours; abuse our refund, remake, chargeback, or delivery policies; or use automated means to overload, disrupt, or exploit the Service.

We reserve the right to refuse service where we reasonably believe the Service is being misused.

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. Where practical, we may provide advance notice of planned maintenance.

We want your experience with lullabygen to feel simple, clear, and reassuring. Because each lullaby is personalized, the final result may vary depending on the selections you provide and the creative nature of the Service. We do our best to reflect your choices as closely as possible, but every personalized result is unique.

Delivery timelines are estimated and may occasionally vary depending on order volume or processing needs. We also do our best to keep the Service available and running smoothly, but we cannot promise uninterrupted access at all times.

Our lullabies are designed to support calming bedtime routines, but they are not medical, therapeutic, or professional advice, and individual results may vary.

To the maximum extent permitted by law, lullabygen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

We may refuse service, limit access to the Service, restrict order access, cancel orders before delivery, or deny future purchases where we reasonably believe there is fraud, abuse, misuse of our policies, or violation of these Terms.

Delivered orders may still be eligible for support, remake, or refund review in accordance with our Refund Policy.

These Terms are subject to applicable law. Where local law provides mandatory consumer rights, those rights are not affected by these Terms.

These Terms do not limit any non-waivable rights you may have under applicable law.
